Land Disturbance Permit Requirements

Fayette County’s Soil Erosion and Sedimentation Control Ordinance has been revised to comply with Federal and State mandated changes. Incorporation of the changes is required to retain the County’s certification as a “Local Issuing Authority”. Key provisions of the new ordinance are as follows:
Erosion and Sediment Control Plan (ESCP) Requirements
An approved Erosion and Sediment Control Plan is required for all projects that meet one of the following criteria:
A. Has a disturbed area greater than or equal to 1.0 acres; or
B. Is part of a larger common development (i.e., a subdivision); or
C. Is within 200 ft of State Waters.
The Engineering Department will have 14 days to review the ESCP. A master ESCP, inclusive of all building lots, will be required for all new subdivisions in the future. This will alleviate the need for lot-specific plans within these developments.
Disturbed Acre Fee
Permit applicants shall pay the County a fee of $40 per acre of land disturbed. The proposed disturbed area shall be provided by the applicant on the ESCP and rounded to the nearest 1/10th acre. Fees will not be prorated below $40.
